The specific scope of services, fees, and deliverables for each engagement will be outlined in a separate engagement letter or service agreement signed by both parties prior to commencement of work.

2. Client Responsibilities

To enable us to provide accurate and timely services, you agree to:

  • Provide complete, accurate, and timely information and documentation as requested
  • Notify us promptly of any changes to your financial situation relevant to our engagement
  • Review all work product (tax returns, financial statements, reports) carefully before signing or filing
  • Maintain your own copies of all documents provided to us
  • Pay invoices in accordance with the agreed payment schedule

You acknowledge that the accuracy of our work product depends on the completeness and accuracy of the information you provide. We are not responsible for errors resulting from incomplete or inaccurate client-provided information.

3. Fees and Payment

Fees for services are set forth in your engagement letter or service agreement. Unless otherwise agreed in writing:

  • Invoices are due upon receipt unless a payment plan has been arranged
  • Late payments may be subject to a late fee as specified in your engagement letter
  • We reserve the right to suspend services for accounts with outstanding balances
  • Fees are subject to change with reasonable advance notice

All fees are exclusive of applicable taxes unless otherwise stated.

4. Confidentiality

As a licensed CPA, Lydia Cantin is bound by professional confidentiality obligations under applicable state and federal law and the AICPA Code of Professional Conduct. We treat all client financial information as strictly confidential and will not disclose it to third parties except as required by law, with your written consent, or as necessary to provide your requested services.

5. Intellectual Property

All content on this website — including text, graphics, logos, and design — is the property of Trofeo Accounting and is protected by applicable copyright and intellectual property laws. You may not reproduce, distribute, or create derivative works from any content on this site without our express written permission.

Work product prepared specifically for you (tax returns, financial statements, reports) is provided for your personal or business use. General methodologies, templates, and processes used in preparing your work product remain the intellectual property of Trofeo Accounting.

6. Limitation of Liability

To the fullest extent permitted by applicable law, Trofeo Accounting and Lydia Cantin shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our website or services, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from our services shall not exceed the fees paid by you for the specific service giving rise to the claim during the twelve (12) months preceding the claim.

We are not responsible for penalties, interest, or other consequences resulting from errors in information you provided to us, your failure to review and approve work product before filing, or circumstances beyond our reasonable control.

7. No Guarantee of Results

While we strive to provide accurate, high-quality services, we make no guarantee of specific financial outcomes, tax savings, or results. Tax laws and regulations are subject to change, and past results are not indicative of future outcomes. Our services constitute professional advice based on information available at the time of engagement.

8. Termination of Services

Either party may terminate a service engagement upon written notice. Upon termination, you agree to pay for all services rendered through the termination date. We will provide you with copies of all completed work product and return any original documents you provided.

We reserve the right to withdraw from an engagement if we determine, in our professional judgment, that we cannot continue to provide services in compliance with applicable professional standards.

9. Dispute Resolution

In the event of a dispute arising from our services, both parties agree to first attempt resolution through good-faith negotiation. If negotiation is unsuccessful, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Estero, Florida. The prevailing party shall be entitled to recover reasonable attorneys' fees and costs.

10. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions.

11. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of our website or services after any changes constitutes your acceptance of the revised Terms.
